A mother in her twenties, who suffered severe injuries at work resulting in the loss of her scalp and ear, has recently received a substantial financial settlement.

Anna Rachfal sustained life-altering injuries when her hair got entangled in a rotating drill while she was operating it. Despite her cries for help, the incident happened swiftly, causing the drill to rip off her scalp and right ear, leaving Anna unconscious.

Following an investigation by the Health and Safety Executive, P&D Engineering Ltd in Coventry was fined £62,000 for not equipping the drill with a necessary guard, a safety measure the company had recognized in its risk assessment but chose to overlook.

Anna has undergone multiple surgeries and continues to experience lasting effects from the accident. Feeling dissatisfied with her employer’s fine, which she deemed humiliating, she decided to seek legal action through the specialized services of personal injury solicitors at Osbornes Law. She disclosed that she still grapples with flashbacks and has been diagnosed with PTSD, anxiety, and depression.

Expressing her sentiments to the Mirror, Anna shared, “The accident altered everything for me. I no longer recognize myself in the mirror. I suffer from hearing loss, dizziness, persistent pain from my scars, and severe nerve pain that immobilizes me at times. The loss of sensation on my head is irreversible.”

She added, “The fine imposed by the HSE felt like an insult. While my employer continued operating as usual, I felt like my life would never be the same again.”

Although P&D Engineering Ltd admitted its failure to ensure employee safety post the September 2019 incident, it was only recently that the company’s insurers agreed to settle the case, just before a High Court trial was scheduled to determine the compensation amount for Anna.

Living in Coventry with her husband and two children, Anna expressed the toll of the defendant’s insurers continuously demanding proof of her injuries. She narrated instances of feeling monitored, judged, and followed, which exacerbated her distress.

Ben Posford, the head of Osbornes Law’s catastrophic injury team, emphasized the avoidability of the distressing incident had the drill been equipped with the necessary guard. He stressed the importance of employers prioritizing health and safety measures to prevent similar occurrences.

Posford added, “I am pleased that justice has been served for Anna, who demonstrated remarkable courage, and that she has been provided with the appropriate settlement to access the required care and support for her future.”

Anna aspires to utilize her experience to assist others coping with life-altering injuries and advocate for improved safety measures in workplaces. She aims to inspire individuals to stand up for their rights and encourage employers to prioritize the welfare of their employees.
