Speaking at the Conservative Party conference in Manchester, Jenrick is expected to argue that the Sentencing Council has diluted sentences and advocate for increased ministerial control over sentencing policies.

The move has sparked backlash from the Labour Party, accusing the Conservatives of neglecting the justice system over their 14-year tenure, leading to overcrowded prisons due to insufficient construction of new facilities. Labour condemned Jenrick’s actions as another self-serving attempt to erode judicial autonomy.

The government recently imposed restrictions on the Sentencing Council following a dispute over perceived unequal justice. Criticism was directed at the Council for suggesting judges consider factors like ethnicity or gender in pre-sentence report requests. Mr. Jenrick emphasized the need for equal treatment for all individuals regardless of background, aiming to prevent a two-tier legal system under Keir Starmer.

Richard Atkinson, president of the Law Society of England and Wales, reiterated the importance of maintaining judicial independence and upholding the rule of law while advocating for sentencing guidelines that ensure consistency and judicial discretion within parliamentary frameworks.
